Consolidated Tourist Use: How to Apply for Your Holiday Rental Home
Consolidated use lets your holiday rental home keep operating with no time limit. Who can apply, documents, the deadline of 13 December 2030 and when it is lost.

Of all the options Law 6/2025 offers to holiday rental homes (viviendas vacacionales) that were already operating, consolidated tourist use (uso turístico consolidado) is the most valuable: it has no time limit. But it is not open to everyone, and it has to be applied for and pass a check. This guide summarises who can apply, how to do it and what you lose if it goes wrong.
What consolidated tourist use is
It is a regime that lets a holiday rental home authorised under Decree 113/2015 keep operating without the 5-year limit that affects the rest. It is regulated in the first transitional provision of Law 6/2025.
Who can apply: the "dual condition"
Only someone who is both:
- the owner of the property, and
- the holder of the declaración responsable for the holiday rental home.
In addition, the property must be duly authorised under Decree 113/2015 and must have been operated effectively and without interruption for more than a year before 13 December 2025. This can be shown with IGIC (Canary Islands indirect tax) returns or other means.
If you manage a property that is not yours, consolidated use is not available to you. You fall under the 5-year transitional regime (until 13 December 2030), extendable once.
Deadline
The deadline to opt for consolidated use is 5 years from 13 December 2025: until 13 December 2030. Meanwhile your old declaración responsable remains valid.
But there is a catch. To file the application you need the classified-activity documentation. If you never filed the prior notification with the town hall, your real deadline is 31 July 2027 (see the guide to the prior notification).
Where and how to apply
You file a declaración responsable of consolidated tourist use with the town hall. Town halls had to publish the form before 13 March 2026.
Documentation
- Copy of the old declaración responsable and proof that it was filed before 13 December 2025.
- In a condominium (propiedad horizontal), a certificate (from the land registry or equivalent) that tourist use is not prohibited.
- A full copy of the classified-activity documentation and of the Decree 113/2015 documentation you declared you had, unless the town hall already holds it.
- The declaración responsable with the property's details (cadastral reference, floor area, capacity, tourist registration number), the holder's details, the absence of public protection status and the effective operation of the activity for more than a year.
The check: the critical point
The town hall reviews the classified-activity and planning documentation and requests a mandatory report from the Cabildo on safety, health, accessibility, habitability, equipment and technical conditions.
If the report is negative, it is binding. Under Law 7/2026, the consequences go further: the consolidated declaration is voided, and the Cabildo also voids your original declaración responsable and deregisters the property.
That is why it pays to file a well-prepared application, backed by a reliable technical report.
What having consolidated use means
- Advantage: no time limit. The 5-year period does not affect you.
- Condition: the property cannot have any residential use while it lasts. If it does, the right is lost.
- Limited works: if planning does not allow tourist use, the property falls into a "legal situation of tourist consolidation". Maintenance, conservation, refurbishment and modernisation works are allowed, but not partial demolition, full renovation, remodelling that extends its useful life or any increase in volume.
- Registrations: it is entered in the Land Registry (at the applicant's expense) and declared to the Cadastre.
When it ends
Consolidated use is lost on:
- definitive cessation of the activity;
- death of the holder (with the inheritance exception we explain in this article);
- transfer of the property by any title, including sale;
- more than a year without operating it;
- total demolition or the end of the right to manage the property.
You can renounce at any time by notifying the town hall of a change of use.
One case where you do not need to apply
If tourist use was already expressly allowed by detailed planning and the change of use from residential to tourist was formalised with the town hall before 13 December 2025, the Decree 113/2015 declaración responsable stays in place without the consolidated-use one. The town hall and the Cabildo can still check and inspect.
Frequently asked questions
Can I sell a property with consolidated use? Yes, but consolidated use ends with the sale. The buyer does not inherit it.
Do I have to apply now? The deadline runs to 13 December 2030, but the classified-activity documentation is a prior requirement and its deadline comes earlier: 31 July 2027.
