Prior Notification for Your Holiday Rental: Step-by-Step Guide
If your vivienda vacacional (holiday rental home) has a declaración responsable but you never filed the prior notification of classified activity, you have until 31 July 2027. Who must file, which documents you need and what happens if you miss the deadline.

If you own a holiday rental home (vivienda vacacional) in the Canary Islands, there is one date you should mark in your calendar: 31 July 2027. It is the last day to file the prior notification of classified activity (comunicación previa de actividad clasificada) if your property has a declaración responsable but you never filed it. This guide explains what it is, who has to do it, which documents you need and in what order to move.
What the prior notification of classified activity is
Using a home for tourism is a classified activity under Canary Islands Law 7/2011. Put simply, the town hall must know that a tourist activity takes place in that property and check that it complies with safety, health, accessibility and habitability rules.
Many holiday rental homes filed the declaración responsable with the Cabildo (the island council) at the time, but never did this step with the town hall. Law 7/2026 of 31 July, which amends Law 6/2025 on holiday rental homes, opened a route to regularise them: the tenth transitional provision.
Who must file it?
You must file it if you meet both conditions:
- You filed the declaración responsable for the holiday rental home before Law 6/2025 came into force (before 13 December 2025).
- You did not file the prior notification of classified activity with the town hall.
You do not need to file it if you already filed it before the reform came into force.
A point of interpretation. The provision is inserted into Law 6/2025, so "this law" is understood to refer to it, and the declaración responsable would have to have been filed before 13 December 2025. Some law firms read it differently. What is not in doubt is the deadline: 31 July 2027.
Which documents you must submit
The law sets a minimum documentation made up of two items.
1. Municipal certificate
A certificate from the town hall proving that the property was built in line with planning rules and holds the required licences.
If you cannot obtain it, there are alternatives. You can prove that:
- the property is out of planning order (fuera de ordenación) because the actions to restore planning legality have already expired (articles 361 and 362 of Land Law 4/2017), or
- its tourist use is consolidated.
Any means of proof admitted in law is valid.
2. Technical report signed by a competent professional
This document shows that the property complies with the rules on classified activities. It must include:
- a graphic description of the property;
- plans of the current state: floor plans, elevation and sections;
- photographs of the façade and the interior.
This report (memoria técnica) is the technical part of the procedure, and it is what we prepare at FuerteProyecto.
Step by step
- Check whether you already filed the prior notification. Look for the receipt. If you have it, there is nothing more to do.
- Request the municipal certificate from your town hall. This is the part that can take longest, so ask for it as soon as possible. If the town hall cannot issue it, work out with a technician which of the alternatives applies to you.
- Commission the technical report from a competent professional. A visit to the property is needed to measure and photograph it.
- File the prior notification with both documents at your town hall. Ask the town hall how it must be submitted.
- Keep the receipt. It is your proof that you met the deadline.
What happens if you miss the deadline
The consequence is serious: if you do not file the prior notification before 31 July 2027, the law provides for the immediate cessation of the activity and the automatic extinction of your title.
And continuing to rent once the title has expired has a cost: Law 4/2017 classifies it as a serious planning offence, with a fine of €15,000 to €150,000.
What filing it gives you
Filing the prior notification lets you take advantage of the law's transitional regime. Depending on your situation, this means:
- consolidated tourist use, with no time limit, if you are both the owner and the holder of the declaración responsable (we explain it in our guide to consolidated use); or
- the 5-year transitional regime, until 13 December 2030, extendable once, if you do not meet that dual condition.
Frequently asked questions
Is the technical report mandatory? Yes. The law requires a report signed by a competent professional as part of the minimum documentation.
Is a professional-association endorsement (visado colegial) needed? No. The association's endorsement is not mandatory for this type of report.
Can I wait until 2027? Legally you can file on the last day. In practice, the municipal certificate depends on the town hall and the report needs a site visit, so leaving it to the end increases the risk of missing the deadline.
Does this replace the declaración responsable? No. The declaración responsable remains the title that authorises you before the Cabildo. The prior notification is the classified-activity procedure filed with the town hall.
