Technical Requirements for New Holiday Rental Homes in 2025

Minimum floor area, bathrooms, energy certificate, renewable hot water, technical report and planning certificate: what Law 6/2025, as reformed by Law 7/2026, now requires of a holiday rental home in the Canary Islands.

Article updated on 17 October 2026. These requirements are in the seventh transitional provision of Law 6/2025, which Law 7/2026 rewrote in August 2026. They will apply until the Canary Islands Government approves the implementing regulation, which does not yet exist.

Before the technical requirements: is it possible in your home?

No technical requirement helps if the home cannot have tourist use. For a new holiday rental home you need:

  • municipal planning that expressly allows tourist use in that area (shown by the planning certificate, cédula urbanística);
  • a minimum age of 10 years for the home;
  • that it is not protected housing (nor has been in the last 10 years);
  • that it is not in an area declared stressed;
  • that the owners' association does not prohibit it.

If your home already operates under a Decree 113/2015 declaración responsable, your situation is different. We cover it in this article on the transitional regime.

Minimum floor area and bathrooms

  • At least 35 m² usable.
  • 2 full bathrooms if the home has more than 4 places.
  • 3 bathrooms if it has more than 8 places.

Homes under 35 m²

They are accepted if they meet the minimum habitability floor area and have at least one of these elements. Physical elements must be on the same plot and available to guests.

  • Private parking space.
  • Individual or shared swimming pool.
  • Sports equipment (gym, tennis, padel…).
  • Health or wellness facilities (spa, physiotherapy…).
  • Private-use garden: 9 m² per place on urban land, or 100 m² per place on rural land.
  • Approved charging point for electric vehicles.
  • Quality and environmental management certification, preferably from the Spanish Tourism Quality System or EMAS.
  • An energy transition plan to reach zero or negative carbon footprint within 5 years.
  • Energy rating A or B.
  • A noise monitoring system.
  • That whoever operates the home is a self-employed worker tied to that operation.
  • Class A efficiency cooling appliances.
  • Compliance with current accessibility rules.
  • Others set by municipal planning.

The last two items on the list, class A cooling and accessibility, were mandatory for all homes in the original 2025 text. Since Law 7/2026 they only serve as an alternative for small homes.

Mandatory requirements for all homes

Energy certificate

  • Buildings existing on 31 December 2007: minimum rating F.
  • Later buildings: minimum rating D.
  • Not required of homes legally excluded from energy certification.
  • If heritage rules prevent reaching the class, the highest possible is enough.
  • Each new declaración responsable will also be subject to the requirements of the European Energy Efficiency Directive (EU) 2023/1791.

If your home does not reach the required class, it has to be improved: insulation, windows, hot-water or cooling systems. A good certificate tells you which measures have the most effect.

Domestic hot water from renewables

The home must produce hot water with solar panels where technically and legally possible. Another renewable installation is also valid if a technical certificate shows that its emissions and non-renewable energy consumption do not exceed those of solar thermal.

Law 7/2026 removed the minimum percentages of the original text: 70 % for homes built before 2007 and 90 % for later ones.

Access

  • Road access to the plot, or to the nearest reasonable point.
  • If the last stretch is on foot or the access is unpaved, this must be stated in the adverts.

The documentation to file

The declaración responsable is filed with the Cabildo, electronically, and must be accompanied at least by:

  1. Tourist activity report, signed by a competent professional, with:

    • plans of the current state (floor plans, elevations and sections);
    • geolocation according to the specifications of the Canary Islands Territorial Information System;
    • photographs of the façade and interior.

    It must show compliance with the rules on building, planning, tourism, classified activities, safety, health, habitability and accessibility.

  2. A planning certificate (cédula urbanística) showing that planning allows the tourist use of that home.

  3. If the home is in a condominium building: a certificate from the owners' association that neither the statutes nor any resolution prohibits tourist use.

In addition, the energy efficiency certificate is needed to show the minimum rating.

The data on classified activities, capacity, cadastral reference and planning regime are considered essential. An error or omission in them prevents continuing the activity and can block a new application for up to 3 years. That is why the technical report has to be done properly.

What Decree 113/2015 still requires

The 2015 regulation remains in force where it does not conflict with the law. Among other things, it requires:

  • A distinctive plaque with the registration number at the entrance, unless the owners' association prohibits it.
  • Registration number in all advertising.
  • An information notice, at least in Spanish and English, with:
    • a contact phone number from 8:00 to 20:00;
    • emergency numbers;
    • house rules.
  • Complaint forms available to the guest.
  • Prices displayed and a signed conditions document (times, maximum occupancy and price including IGIC), at least in Spanish and English.
  • Reporting of guests' data to the Police.
  • Minimum equipment:
    • interior security lock and first-aid kit;
    • blackout in bedrooms and a reading light by each bed;
    • beds of minimum size (0.90 × 1.90 m singles and 1.35 × 1.90 m doubles);
    • bed linen and towels per guest;
    • hairdryer;
    • oven or microwave, coffee maker, kitchenware, iron…
  • Not exceeding the capacity set by the bedrooms. Housing 150 % or more of capacity is considered a serious risk and can lead to closure.

Does your home comply?

At FuerteProyecto we review the home, write the technical report signed by a competent professional and issue the energy certificate, with the necessary improvements if you do not reach the minimum class.
