Transitional Provisions of the New Holiday Rental Law: How to Make Sure Your Home Gets the Best Deal
Law 6/2025 offers existing holiday rental homes two paths: consolidated tourist use, with no expiry date, or a 5-year transitional regime. Who can use each, what documentation is needed and what deadlines Law 7/2026 sets.

Article updated on 17 October 2026 with the final text of Law 6/2025 of 10 December, in force since 13 December 2025, and its reform by Law 7/2026, in force since 15 August 2026.
Why the transitional provisions matter
Law 6/2025 changes the rules for new holiday rental homes. For those that were already operating under a declaración responsable (DR) from Decree 113/2015, the future is decided by its transitional provisions.
The first two are the ones that affect almost every owner:
- First transitional provision: consolidated tourist use. It is the good option: it does not expire.
- Second transitional provision: a 5-year transitional regime, extendable. After the period, the DR lapses.
To these is added the tenth transitional provision, which Law 7/2026 added, with the date that worries people most: 31 July 2027.
First transitional provision: consolidated tourist use
Who can take advantage of it
Only someone with the dual condition:
- being the owner of the home, and
- being the holder of the declaración responsable for the holiday rental home, filed under Decree 113/2015 before 13 December 2025.
If the DR is in the name of a management company and not the owner, there is no dual condition.
Requirements
In the declaration of consolidated use you must state, and be able to prove:
- That you have operated the home effectively and without interruption for more than a year before 13/12/2025, since you filed the DR. IGIC returns or any other valid proof will do.
- That the home is not and has not been protected housing (or that it has been declassified).
- That, if it is in a condominium, the owners' association does not prohibit tourist use.
In addition, you must provide all the classified-activity and Decree 113/2015 documentation that you declared you had at the time.
Where and until when
- It is filed at the town hall, not the Cabildo.
- The deadline is 5 years from the law's entry into force: until 13 December 2030.
- Meanwhile your old DR remains valid, and new municipal planning does not prevent it.
The check
- The town hall reviews the classified-activity and planning documentation.
- It then requests a report from the Cabildo, which checks safety, health, accessibility, habitability, equipment and technical conditions.
- If the Cabildo's report is negative, it is binding: the town hall voids the consolidated use. Since Law 7/2026, the Cabildo also annuls your original DR and deregisters the home from the General Tourism Register.
What it means
- It does not expire: the 5-year limit of new DRs does not affect it.
- The home cannot have any residential use while it lasts.
- If planning does not allow tourist use in that area, the home falls into a legal situation of tourist consolidation:
- maintenance, conservation, refurbishment and modernisation works are allowed;
- partial demolitions, full renovations and increases in volume are not.
- It is entered in the Land Registry and the change of use is declared to the Cadastre.
When it is lost
- If you sell the home.
- If you stop operating it for more than a year.
- If you definitively cease the activity.
- If the home is demolished.
Inheritance exception (Law 7/2026): if the deceased owner had the dual condition, the heir can notify the Cabildo of the change of holder and continue for a maximum of 10 years from the inheritance.
When you do not need the declaration of consolidated use. Your area may already have had tourist use expressly allowed by planning and you may have formalised the change of use with the town hall before 13/12/2025. In that case you keep your Decree 113/2015 DR with no further steps.
Second transitional provision: 5 years for the rest
- Who it applies to: anyone who does not opt for consolidated use or cannot, for example a management company operating someone else's home.
- Deadline: you can continue for 5 years, until 13 December 2030.
- After that the DR lapses and you must stop, unless the home is authorised under the law's new regime.
- If the operator is not the owner, the DR lapses earlier if their contract with the owner ends.
- One-off extension of up to 5 more years (maximum 10, until 13/12/2035):
- it is requested from the Cabildo before 13/12/2029;
- you must show that the 5-year period does not compensate for the loss of the title;
- if the Cabildo does not reply within 6 months, it is deemed refused.
There is a third way to extend the DR up to 20 years: putting another home up for long-term rent (third transitional provision). We analyse it in this article.
Tenth transitional provision: prior notification before 31/07/2027
It is the most important change in Law 7/2026 for anyone already operating.
Situation: you filed the DR with the Cabildo, but never the prior notification of classified activity with the town hall.
Deadline: until 31 July 2027.
What you must provide:
- A municipal certificate that the home was built in line with planning and has its licences. Instead you can prove it is out of planning order (no planning action can any longer be taken against it) or that its tourist use is consolidated.
- A technical report signed by a competent professional, with plans of the current state, photographs and justification of compliance with the classified-activities rules.
If you do not file it before 31 July 2027, you must stop the activity immediately and your declaración responsable lapses automatically. Without this notification you also cannot safely complete the declaration of consolidated use.
Step by step to secure your home
- Check ownership. Is the DR in your name and are you the owner? If not, consider regularising it with a lawyer.
- Check the date you filed the DR and that the home is still registered on the General Tourism Register.
- Gather proof of continuous operation: IGIC returns, bookings, invoices.
- Check whether you filed the prior notification of classified activity at the town hall. If not, commission the technical report and request the municipal certificate.
- Review the home's technical state against Decree 113/2015 (equipment, safety, habitability), because that is what the Cabildo will check.
- File the declaration of consolidated use at the town hall before 13/12/2030. The sooner, the better.
